These terms govern the use of OFSKI EMS, an online back-office system for live event companies, provided by Ofski, MB.
1. Who we are
Ofski, MB, company code 304215619, Naugarduko g. 26-13, LT-03225 Vilnius, Lithuania. Email: info@ofski.dev. In these terms, “we” and “us” mean Ofski, MB; “you” means the customer who uses the Service.
2. The Service
OFSKI EMS is provided as an online service. Each customer gets its own workspace with its own data. We may add, change or remove features as the Service develops.
3. Accounts
You need an account to use the Service. You must give accurate information, keep your login details secure, and are responsible for everything done through your account. Each person uses their own login. The Service is for business use and for people aged 18 or over.
4. Fees
Fees and the billing period are agreed in writing or shown in the Service. Fees are paid in advance and are not refundable, except where the law requires it. VAT is added where it applies.
5. Your data
You own the data you enter into the Service. We store and process it only to provide and support the Service, and we do not use it for any other purpose. You can ask for an export of your data at any time while your workspace is active.
6. Acceptable use
You must not use the Service to break the law or infringe the rights of others, upload malicious code, attempt to access other workspaces or our systems, or resell the Service without our agreement.
7. Availability
We aim to keep the Service available, but we do not guarantee uninterrupted operation. Maintenance is normally carried out at night.
8. Liability
The Service is provided “as is”, to the extent permitted by law. We are not liable for indirect losses, including lost profit. Our total liability in any 12-month period is limited to the fees you paid for the Service in that period. Nothing here limits liability that cannot be limited by law.
9. Term and termination
Either party may end this agreement with 30 days’ notice. We may suspend or end it at once if the Service is used unlawfully or in serious breach of these terms. After the agreement ends, your workspace is kept for 30 days so you can export your data, and is then deleted.
10. Changes to these terms
We may update these terms. We will tell you by email before material changes take effect.
11. Law and disputes
These terms are governed by the law of the Republic of Lithuania. Disputes are resolved by the courts of Vilnius.
